Let me give you some background information about my situation. I was arrested for DUI last September and sentenced to one year probation and daily breathalyzers. I have had clean breathalyzers every day since my sentencing for almost six months now. About two weeks ago I had a positive breath test with a result of .006, followed by another confirming breath test less than five minutes later with a .000 result. Am I not mistaken or is this a false positive? My first reaction was that I had been very sick for the last few days and had been taking various madications which could have provided a positive number; however, if alcohol was in my system at all, wouldn't it be impossibe for me to blow .000 with the second test so close to the first one being a .006? In order to cover my but I called my probation officer the next morning right when her office opened. She was hesitant to tell me anything i should do and tried to make it sound like I was basically screwed. One thing she said was "well if you were so sick bring me a doctors note". So that same day I went to the doctor and was actually diagnosed with pneumonia and given various other perscriptions with alcohol in them.
Is there any advice from anyone? Anyone heard of any situations like these?
I have to do weekly breathalyzer test will Benadryl make me test positive
If you are on probation and your urine tests come back positive you are at the mercy of the court. They will sentence you as they see fit for breaking your probation.
A simple kiss on the lips will not; however, heavy passionate kissing with an intoxicated person can cause a false positive in a breathalyzer test.
No, it should not affect this test.
Yes.
If you haven't eaten for a period of time will it give a false positive reading on a breathalizer test
cranberry juice and lots of water
Yes, he could be tampering with the testing materials, or someone else may be. However, there is no benefit to be gained by anyone doing so. Odds are, the Probation Office is using the cheapest testing materials they can find.
"I'm not sure, but I'm pretty sure that if you have a license for it (medical marijuana), then even though you test positive for it, you wouldn't get in trouble." All I have to say on this one is it most defiantly depends on the county in which you got in trouble. I am currently on probation in Colorado where pot is almost legal, and I can not smoke because Aurora does NOT recognize medical licences, and you WILL get your probation revoked if you smoke cannabis.
