You must be unmarried or legally divorced in order for a California marriage to be valid; if you were not legally divorced but remarried anyway, the second marriage would not be considered valid. Couples in this circumstance are sometimes advised to annul the current marriage, complete the legal divorce, then remarry after the divorce is final. Be sure to obtain written proof your divorce is final! Every California county has different rules about what proof they require in order to obtain a marriage license--here in Los Angeles County you must present proof of dissolution if you were divorced within the last two years, but in Orange County only if you were divorced within the last ninety days--so be sure to check with whatever County Clerk's office you will be visiting to obtain your new marriage license.
