Obviously, this is not an uncommon problem. And there are many different solutions used in different circumstances.
How much and how the attorney will be paid is something to be discussed during the first meeting (which is normally done and should be specified as free), before he agrees to represent you.
At the very least, if he cannot suggest anyway you can afford him, he should have recommendations on where you can find affordable or free representation.

Not really, because the Trustee will want to get that money to pay off your creditor. You dont have a "right" to that money but it will instead depend on the amount of the refund and any local trustee practice.

The company wants their money so if the primary doesnt pay then the cosigner must. Their is no way of getting around this. Bankruptcy should be outlawed. If you cant afford things dont take on the debt.

There is no statute of limitations on debt. If you owe it, you always owe it, unless the debt is 'discharged' during a bankruptcy proceeding.
