If he is not on the birth certificate, in order for him to not get arrested for kidnapping, he would have to prove, through DNA, that he is, indeed, the biological Father. Then, he would have to have the birth certificate changed. If he is on the birth certificate and there is no set custody arrangements and, you live in the same home, he has as much right to the child as you do. Even if he does not live in the home and there are no court rulings as to custody, and he is named as the biological Father, the same would apply.
