To be a law, it must have legislation to support it. However, there is what is referred to as 'common law' which deals with things that are either so obvious that no one has bothered to pass a law on it, or tradition/usage has established as 'just the way we do things.'

An example is that murder is not always defined in the criminal statutes of some states, because we all know that murder is illegal. The same state may very well define sentences for committing the crime.
