Right to Use the Property

It is a question of intention whether the bailee may use the property for his benefit. If none is expressed, the intention of the parties must be determined from the surrounding circumstances, including the nature of the property and the nature and purpose of the bailment.

Right to Insure the Property

The bailee has an insurable interest in the property bailed and may take out insurance on the property. Generally he is not required to do so, although in some instances the bailee may be required by custom, agreement, or statute to insure the property. A commercial bailee, such as a warehouseman, may do so voluntarily in order to make his service more attractive to the public.

Right to Compensation For Services

Whether the bailee is entitled to compensation for what he does depends upon the agreement. In the absence of an agreement to the contrary, courts assume that the bailor intended to pay the reasonable value of services rendered, unless the circumstances are such that reasonable men in the position of the parties would have realized that the services were rendered without the intention to charge or the expectation to pay.

Bailee's Lien

A bailee who according to agreement performs services that enhance the value of the property has a specific common-law lien on the goods. Other ordinary bailees for hire are not entitled to a lien, but the parties can expressly provide for such a lien in their contract.

Statues commonly provide that a lien is retained even though the property is returned to the bailor. In the absence of statute, however, the lien merely confers the right to retain possession and is lost if the lien-holder voluntarily parts with possession.

No lien arises when the work is done on credit. When the repairman retains possession of the bailed article for the purpose of asserting a lien on it, he cannot at the same time charge storage for the time that he retains the property.

Action Against Third Persons

The bailee has a possessory right in the goods bailed. This qualified property right entitles him to bring an action against third persons for interfering with his possession or for injury to or destruction of the goods. The bailee can then recover damages for his loss or for his and the bailor's loss.
