Police, lawyers, and judges are expected to do what is most impactful to the specific person.
If two kids were caught with alcohol, they've committed the same crime.
If kid 1 is an otherwise upstanding person, who's never been in legal trouble, and kid 2 is a known drug dealer, their cases need to be handled differently.
For kid 1, the fact that he was caught is punishment and embarrassing, thus something as simple as community service may deter him from committing similar crimes.
Kid 2 has had run-ins with the law before, and obviously has no intention of changing his ways. If kid 2 were given community service, he'd see it as a "slap on the wrist", and take it as encouragement to go commit more criminal activity.
The punishment is meant to match the person, not the crime.
