No Candy has not ever received ANY citation for DUI! While she is not a favorite person of mine, I do have great respect for her. I was friends with her survivng twin daughter for many years. There was always "breaking news" regarding both Candy and Serena. Once I was sleeping over and we were awoken to news that Serena had been killed by a drunk driver. She was sitting right beside me, alive and well. I will never understand why people have to throw stones at good people. With so many horrific things, true things going on, I have to wonder who is either that bored or that sad that they are fabricating stories. An ex post facto law is one that prohibits that which was formerly legal, and reaches back in time to punish that which was already done back when it was legal. It also includes retroactively increasing the punishment for past crimes. The US constitution, Art 1, sec 9, prohibits such laws. However, there is a great deal of legal controversy over whether a legal provision "punishes" the past act, and whether it is doing so retroactively. For example, suppose a state prohibits drunk driving as a misdemeanor, and you are convicted of it twice. Then the state passes a law making a third drunk driving offense a felony. Then you get caught drunk driving again. The state can punish you as a third drunk driver because the only thing that is being punished is your third act of drunk driving while having two priors, and your third act occurred after the law was passed. In Kansas v Hendrick, 521 US 346 (1997), Hendricks was convicted of a sex offense in 1984 and sentenced. While in prison in 1994, Kansas passed a law for civil commitment of "sexually violent predators." After Hendricks served his criminal sentence, he was locked up anyway (though this time in a state hospital), with his acts leading to conviction and other past acts being the basis for a finding that he continued to be dangerous to the public, allowing his continued incarceration. The US Supreme Court, by a 5-4 vote, ruled that this "civil commitment" was not "punishment" and therefore allowed it to happen. This ruling, in the eyes of many commentators, has gutted the ex post facto protection enshrined in the constitution.
Indeed you can be convicted for DWI, regardless of whether or not a breathalyzer was used, if the Police officer that stopped you had reason to be suspicious of you being intoxicated while driving; ie: you were swerving or driving really slow, then proceeded to pull you over and could tell you were drunk by possibly your actions either verbal or non verbal they can bring up charges in the court of law and have a reasonable case against you. I wasn't there but if you actually were DWI it was probably pretty obvious to the officer so I would save your self some time and plead guilty. Good luck to you anyways. The above is the most ridiculous answer I've ever heard. ANY defense lawyer specializing in drunk driving cases would be able to get you off if there was no breathalyzer nor chemical test done to prove intoxication. Without these tests the definition of intoxication would be at the whim of the arresting officer. "He looked drunk to me."

Yes it does count as a crime. Depending on where you are, it may be a heftier penalty, where i live, it is considered public intoxication but they call it drunk and disorderly, basically its being publicly drunk or being at home but causign problems while under the influence. They can't come into your home and just arrest you for being drunk you need to commiting a crime or disturbing the peace while under the influence to be charged as drunk and disorderly.
