The Lumbee of North Carolina have no archaic Indian customs or habits, no indian religion, no Indian language or names, no treaties or reservation and have never been a sovereign tribe. Their ancestors lived through colonial times as 'individuals" same as everyone else not tribal, they were invented by political lobbying in 1957 after failed bills to be enrolled as Croatan then Cherokee of Robeson County and finally a bill before congress in 1940 to be renamed and enrolled as 'Cherokee Indians "despite lack of any connection culturally or linguistically .The Lumbee Tribe is a self identified group who claim Native American Cheraw heritage these days, The Lumbee are not recognized by the Federal Government and have changed their identity and origins over the years from Croatan to Cherokee Indians, Their claim is controversial and is not fact based but based on the myth of the Lost Colony Croatan, the state of North Carolina recognized them based on this myth for political reasons only but the federal government has no historic records of this group whom Prominent genealogist claim were invented in 1957 from people formerly identified as mulattos whose identity had been disputed or unsure by a political lobbied concession called the Lumbee act, which let the group use the name Lumbee after the Lumbee river to describe themselves but without Federal Recognition or acknowledgment.

States however have no constitutional authority to create or uncreate a Indian tribe, this power lies in treaty ability and rest only with the federal government. Any group may use a states slack rules to get state recognition which
