Believe it or not, you cannot get extra jail or prison time just for fleeing from a probation violation. You can for the VOP itself, but there's no difference whether you get arrested immediately, turn yourself in, or flee/abscond. Of course at any time you can be arrested, and it often happens when you least expect it.

Generally the most serious thing that could have happened to you for the VOP was that you would have been remanded to jail to serve the unexpired term of your original sentence. However, NOW, you have made yourself a 'fugitive' and possibly even an 'escapee' which are additional separate offenses. Probation IS a sentence for havng been found guilty - it is NOT a 'get out of jail free' card!

To start, this must be approved by your probation officer. If your probation officer will not approve it you can not leave. If your probation officer will approve it, they will need to request that the probation department of another state accept you for probation supervision in their state. Your current probation officer will have to request this through a process called "Interstate Compact." If and when another state accepts you, you will be assigned a new probation officer in your new state. There are potential complications if you are approved as well. The judge from the state that convicted you has little power to enforce the terms of your probation agreement. That means the probation department in the state you move to can impose any conditions that they consider to be appropriate. For example, if a Judge in the state that convicted you did not require a treatment program for your offense the new states probation department may or they may make your live miserable in other ways by imposing restrictions that make it difficult do do almost anything at all. When they impose these restrictions there is little you can do about it because they will not take orders from your home state judge since it is out of their jurisdiction. If you are considering moving out of state while on probation and without approval, I would highly advise against that. This would be a violation of your probation and would likely get you arrested.

If you are fleeing the state to avoid prosecution for the crime, or in violation of probation or parole, it may be possible that the state MAY suspend or revoke your drivers license privileges in order to throw a "roadblock" in your ease of movement.Realistically, if you are fleeing prosecution - you'll eventually be caught anyway - and just like Murphy's Law, usually at the worst possible time and moment for you. Why not just face it and get it over with?

The best answer anyone can give is...it depends. It depends on the original crime and sentence. It depends on the past criminal history of the offender. It depends on whether the PV (probation violation) is a new crime or a violation of administrative rules. At the minimum, if the offender leaves the state and actively avoids capture, the state will issue a bench warrant. They may list the offender as a fugitive, which brings the FBI into the fray. If they have an idea where the offender absconded, they may contact law enforcement in that area and ask for the person to be picked up. After that it is a simple matter of extradition, and the fleeing and elluding can be added to any new charges. The best solution is to come clean and turn yourself in. The punishment is likely not as serious as it would be if you flee.

Did you finish out your probation? If they didn't charge you with the violation while you were on probation, they aren't likely to charge you now. If you are still on probation, there is no statute of limitations. It's pretty much a given, in whichever state, that once you're in custody or sentenced, any flight or further violation is not subject to any "statute of limitations": the charges will never expire!
