It depends on what state your in but I believe that the no seatbelt law is nationwide in which case you will get a ticket if in the front seat of a car and are not wearing a seatbealt if your over the age set by the law. In the UK it is always an offence.

you can legally have as many people in the car as there are seatbelts. if you only have 4 seat belts, there can only be 4 people in the car,as the law says, every person must wear a seat belt
I believe CA state law requires it in the back seat. Call the CHP office near you to ask this question before you get a ticket.
This can vary depending on if seat belt use is required by law but rule of thumb is: If the car came equipped with the shoulder belt it must be used.
The law is 6 years old AND over 60 pounds. IF the child does not fit both then he/she must still be in a car seat.
