A capital crime is one which usually involve severe body harm like murder. An infamous crime on the other hand refers to one which gains notoriety for some reason but may not result in anyone being prosecuted or executed.

(This is why one sometimes hears of a sentence of a year and a day, although in some cases a lesser sentence can be given.) Such a crime can also be called a felony, or an indictable crime.

Capital crimes are any crimes that are subjected to capital punishment. In the US, they have to involve taking a life (or treason, although that has not been tested by the Supreme Court as to constitutionality).

Infamous crimes would be any felonies or non-felonies that are crimes of moral turpitude. They show that the person who committed it is generally untrustworthy (for example, it can be used to impeach them on the witness stand). They include things like thefts, forgery, perjury etc.
