There have been thirty-three amendments to the US Constitution since it was written. The First Amendment specifically forbids the establishment of religion.

New Hampshire was one of a small number of colonies (I think Massachusetts was the only other one) that had its own constitution prior to the establishment of the US Constitution. But it was New Hampshire's ratification and signing of the US Constitution in June of 1788 that established the US as a nation, and the Constitution as the law of the US. This is because New Hampshire was the 9th of the 9 required ratifying states to accept the Constitution. So it was really at that time that New Hampshire was established as a state in the union.

I believe that the constitution is manditory for a succesful establishment.
The establishment had been there for over 100 years. The establishment of the new business was a landmark for the community. The injury led to the establishment of a new procedure.
The establishment clause of the constitution prohibits an establishment of religion or the free exercise of religion. The congress is required to abide by the constitution.
Prohibits the government from making any law regarding the establishment of religion. Essentially, it is the "separation of church and state" portion of the constitution.
