Its against the law any way you look at it. You cant tattoo a minor in your state. NO exceptions. Its a class A misdemeanor. Its also against the law to tattoo without being licensed.
When you let a unlicensed tattoo artist tattoo you, you have a greater chance of a botched tattoo, and of becoming infected from improperly handled tattooing equipment
As long as you're not tattooing without a licence, have a clean studio to work from and put in the effort you'd expect someone to put in with you then I cannot see any ethical pitfalls. On the other hand if you are a 'scratcher' (unlicensed tattoo artist) then you are putting people in danger of infections or even worse.
It would clearly be illegal. No one is allowed to tattoo without a license. And no one may tattoo a minor. There is an exception to cover an existing tattoo where a parent may take a 16 or 17 year old to a tattoo parlor.

It depends on the reason for the lawsuit. If you knew the tattooist was unlicensed before you had a design done, you can't expect to win a case against them - as you chose to enter their business and have the work done. Sure - the tattooist could be prosecuted for unlicensed practice - but that case would be brought by the state - not an individual customer.
