In the state of New York, there is no age in which a child can legally choose which parent to live with in a custody case. However once a child reaches age 14, the court will be more inclined to make a decision based on the parent the child chooses as long as the situation is deemed proper and safe.

A judge uses their own discretion when asking a child specific questions,it will probably be in their chambers without you,so be sure to go through possible questions before your in court with the child and make sure you know they are gonna say what you want to that judge...take the time and effort to acheive the results you desire,ice cream and feeding the birds in the park does wonders,once they are distracted even a 3 year old can say who they like better,mama or dada,if you keep asking them when YOU are supplying the fun they will associte fun with you and when your not around and some judge asks them the same questions they should be pretty much acting like a robot and saying your better. There is not set age at which a child gets to decide that,it's up to a judge and each child is different,and they ask alot of different questions,the older a child the more they can just express to a judge what they would like,the closer to being a teenager they will vocalize nice and loudly who they want to live with and if they don't get it,they are sure to make who they are sent to live with life a living hell.Sometimes it's best to give a kid what they want.I know in NH also there is not set age to emancipate a child either,and around age 14 they could be emancipated by the judge and then none of you can have a say what they do.

A minor can only move with parental consent and if the court ha given custody to one parent that is the parent the minor have to stay with. A minor can not choose who to live with until he is 18.
No he can not. A step parent have no legal right to the step children. This could only happen if the parents consent to it. A minor can not choose but the court will hear their opinion at 16. They might not follow it though.
