File a small claims case. Some states have Housing Courts, which are better at dealing with these issues than standard District Courts.

Does a landlord have a right to hold back a security deposit if the tenant dies?

Death of the tenant terminates the tenancy. The landlord should handle the security deposit according to the law, which likely means forwarding it to the estate. If rent is owed, the landlord could apply the deposit to the arrearage, and so notify the executor. There is an argument that the decedent owes rent for the next month (in a month-to-month tenancy) or the remainder of the lease (if there is a lease). However, the landlord has an obligation to try to rent the unit.

Can a tenant demand security deposit when moved out owing rent and gave no notice?

If no notice is given, then the tenant owes for the next month, if the landlord tries to rent the unit and cannot. The security deposit can be applied to the arrearage - the landlord needs to write the tenant a letter so stating.

How do you go about getting your security deposit after waiting 2 months?

First, review the terms of your rental agreement to make sure you comply with all conditions for receiving a security deposit refund. Next, contact your landlord or property manager directly to inquire about the status of your security deposit. If they are unresponsive or refuse to return it, you can file a dispute through small claims court or seek legal advice depending on your jurisdiction.

How much of a security deposit must be returned if a month to month renter leaves and gives very little notice?

Possibly all. If the landlord fails to rent the unit (after trying), the landlord could use the entire deposit towards the next month. He would need to write a letter (in most states within 30 days) saying what he did with the deposit.

Can overpayment on rent be applied to damages?

If you were required to pay a security deposit prior to moving in, overpayment would not apply to that unless you have a verbal or written agreement with the landlord. Typically, if you make an overpayment on rent, it would be applied to next month's balance.

When a tenant vacates an apartment is it right for the landlord to deduct money from the security deposit to pay to clean and paint the apartment for the next tenant?

The purpose of a security deposit is to pay the last month's rent in the event that a tenant stops paying and has to be evicted, not to pay for cleaning and painting. It would only be reasonable to use a security deposit for this purpose if the departing tenant left the apartment in extremely bad condition, requiring an abnormal expense to restore it.

Rent on the 15th the landlord verbally tells you on the 23rd to leave the 15th of the next month no legal eviction given no lease he expects full rent on the last day can I leave before and not pay?

This would be an illegal eviction. The landlord is required to give you notice of lease termination (be it for breach for just they don't wish to renew). If you're renting month to month, they must give you a full months notice. You can try a bit of legal puffery with the landlord and inform him that his way of doing this is illegal and you will seek a claim for the full security deposit back and illegal eviction damages. If your rent and lease began on the 15th of the month, the landlord would need to give you notice by the 14th in order for the tenant to be expected to vacate by the 15th of the next month. Lets assume for example sake, that the month is March and it's the 14th. The landlord gave you notice to vacate on or before April 15th, 2015.You are still obligated to pay the rent for March & April (Feb 15th - March 15th, March 15th - April 15th). As long as you move out ON or BEFORE April 15th & return the keys to the landlord, you're no longer obligated to pay rent to the landlord.

Can your landlord have you pay for painting before you mve out?

If you received permission to paint the property from the landlord, you're obligated to return the apartment in the same condition as it was given to you. That means the paint on the walls too. So yes, even if you received permission to paint, you're still obligated to return it to as close as possible to the original wall color. If, however, you did not paint the premises at all and the landlord is demanding you pay for repainting for the next tenants enjoyment, that may be a huge no. The landlord cannot expect tenants to repaint after the duration of their tenancy. Minor paint damage (areas of peeling, knicks in the paint, nail holes, etc) are typically defined as ordinary wear and tare. As such, they're exempt from damage claims.
