No 240sx has a thermostatic air cleaner, only an air filter
in the air cleaner
you car will not run Right and will use more fuel or may cut out
It wont effect it to were you will feel it. But it may or may not get better mileage.
There is only one air cleaner, aka air filter, on 1980-1993 Cabriolets. It is located in the air box, which is directly below the fuel distributor; the entire assembly is behind the battery. There are four metal clips that mate the fuel distributor housing to the air box.

In HVAC (heating, ventilating, air conditioner) A thermostatic switches the unit from cooling to heat. In Heat pump unit it's the four-way valve or reverse valve. However, the thermostatic still controls it.
I don't have a smog manual in front of me, but TAC is a very common component and is almost certainly required in California. If there is any evidence that it had one at some point, then it is definitely required.
