first, just by having to ask at least suggests you need a lawyer. The filing and process is MUCH more difficult than just seeing if you can go BK. Requirements (which are very minimal) have little to do with IF or HOW or WHEN you SHOULD or SHOULDN'T. Doing it wrong, even just by a bit, leads to a bad result, up to and including criminal charges. There are going to be many terms you need to absolutely know the definition to to provide correct answers for.

The FEDERAL Bankruptcy Court, for the circuit that has jurisdiction for your area ca discuss some of the requirements...what form the filing takes, etc.
