This appears to be a question, and a situaton, that can only addressed by the employer' Human Resources Department. The retirement plans of employer's are usually not subject to the provisions of statute law. That being said: Unless his earlier choice has already set wheels in motion that cannot be stopped, it appears logical that the individuals encashment could simply be re-calculated and reduced by the amount of leave they took.
