Can you receive termination pay and severance pay?

The payment of the employee's final wages is different from severance pay. Final wages are mandated by law to be paid -- an employee who is discharged must be paid all of his or her wages, including accrued vacation, immediately at the time of termination. On the other hand, severance pay is a special form of compensation from the employer. There is no law requiring an employer to offer or provide such. So in case of termination, the employee may receive both his final wages as well as a severance pay package (if provided by the employer).

Is there pecific paperwork for terminating fathers parental rights in tx?

Yes, in Texas, specific paperwork is required to terminate a father's parental rights. This typically includes filing a petition for termination with the court, which must detail the reasons for the termination, such as abandonment or neglect. Additionally, the court will require evidence to support the claim, and a hearing will be held to determine whether the termination is in the best interest of the child. Legal assistance is often recommended to navigate this process effectively.

Can a restaurants fire worker over broken dishes?

Most likely. It depends on several criteria. If the employee works in an 'at-will' state and there is no clause in the company handbook that termination must be 'for cause,' then the employee can fire any employee at any time with no notice. However, if the employee hand requires termination 'for-cause' (that is, a reason for termination), the termination would be based on whether or not the broken dishes constitute a breach of the terms of employment specified in the employee handbook. In this case, my guess is that a single broken dish would not qualify as a breach, and that an employer would not fire an employee for such a reason. However, if the dishes were broken in an act of malice, or if the employee consistantly breaks dishes this could surely be considered a documented sign of either insubordination or utter incompetence in the fulfillment of assigned duties. Thus, the employer could terminate 'for-cause.'

Should an employee be paid on the last day of employment when terminated by the employer?

The employee MUST be paid for any time they spend at the workplace leading up to and including the termination itself. If the employee reports to work and is fired five minutes after clocking in, those five minutes must be paid. If the employee reports to work and is fired before being clocked in no pay may be due for that day. Some states have "minimum pay" laws stipulating that if an employee is compelled to report to work they must be paid for at least X number of hours (normally 2). You should check to see if your state has such a law, and if it does, you probably must pay the minimum hours even if the employee does not have the chance to clock in before termination. You should consult with an attorney or HR professional for completely accurate advice pertinent to your situation and location.

How does the right to work law help employees agaINST wrongful TERMINATION?

In US states that do not have right to work laws and the employee decides he or she does want to join the union associated with the company, the employee must be terminated. The reason for that is that the Union and the company have agreed during their collective bargaining, that new employees must join the union. Conversely, in states that have right to work laws, the union cannot force an employee to be terminated.
