Thus as one example, the Constitution forbids unusual or cruel punishments, however, if a State chooses to enact a death penalty law in its penal code, that's an internal State affair. The death penalty law however, must be in line with the Constitution. Also, if a State chooses NOT to have a death penalty, then that's fine as well as the US Constitution does not instruct States that they must have a death penalty.
