If you are the legal guardian, then you are responsible for what the kid does. You might have a clause in your home insurance that covers something like this.

It is the driver's fault because they should ALWAYS be on guard and attentive, even if a child runs in front of his/her car. But, if the child was un-supervised, it is a stalemate

if your car was parked and it wasn't an accident in traffic, yes, the parents of the minor have to pay for your car if you don't have an insurance that would cover that.
