I don't know if there's a provision but, depending on which state you live in a car is totaled when the repairs cost more than 50-75% of the car's value.

If your vehicle was damaged but not totaled can you request that the insurance company replace it with a new vehicle if the accident was not your fault?

Fault in the accident is not a consideration. Normally the insurance company or the at fault driver is responsible only for repairing your vehicle and providing you with a rental car. While this may not be entirely fair, it is the system and you agreed to it when you chose to drive. Some states do have a provision that a vehicle must be totaled if the damage exceeds a certain percentage of the total value of the auto. YOur best resource is your insurance agent. lwpat

What if the car in front of the car you hit doesn't get hit are you at fault?

Assuming the question is asking in a three car accident the rear most vehicle doesn't strike the front vehicle, could fault be assigned to the rear most vehicle. Answer: Yes, in many states. Laws vary from state to state and depending on the circumstances and the reporting of the police officer on the scene. The officer would determine fault in the accident, which most typically falls on the rear most vehicle who initiated the collision. You are at fault for any vehicle you strike in a rear end accident.

If someone not on my policy is driving my vehicle and has an accident is the claim covered?

If your insurance policy has permissive use then another driver would be covered in your vehicle if they had an accident. I don't know about other states but in California they should not be living with you and they can not be excluded from your policy. One more thing, they MUST have a valid license.

What two accident forms need to be in a vehicle at all times?

In the United States, "Vehicle Registration" and "Proof of Insurance". They are not so much "Accident Forms" as they are required by state law to be present in every vehicle driven on state roads. They are asked for, along with the drivers "Drivers Licence", by the police officer every time they pull someone over.

Can auto insurance be cancelled after a car accident?

Yes, you can cancel a policy anytime you want to if you are the policyholder. I always suggest that you wait until the adjuster has a chance to look at the vehicle and determine if it is totaled or not before cancelling. Speak with your agent about this matter as well. In some states you need to cancel the tag before cancelling the insurance or you will incur a fine. If it is financed you will also need to consult the finance company as well.

What if you have no liability insurance and have an accident?

Well, generally you get a fine (ticket) to pay, Most states will now confiscate your vehicle and suspend your drivers license. If you were at fault in the accident you can also be sued by the other driver and any passengers that were injured.

What is the first thing that I should do if I've had a vehicle accident but no other vehicle was involved?

The first course of action following an accident should be to contact the local authorities or police. Even if no other vehicle is involved there may be damage to anothers property as well as your own vehicle and a police report is helpful to have for claims that will be made against your insurance policy. In many states it is also illegal to leave the scene of an accident with any type of damage present whether it be property or vehicle damage even if your own vehicle, so contacting the police should always be your first course of action if your able to do so.
