He wasn't writing to Birgingham jail, he was writing from the Birmingham jail, where he was being detained at the time, to his "fellow clergymen" of Alabama. he was arrested for protest in Birmingham Dr. King and others were arrested for violating a preliminary injunction issued to prevent Dr. King and others from participating, organizing or promoting any marches or protests in Birmingham without a permit. While in jail, Dr. King composed his famous letter from the Birmingham jail. Ultimately, the US Supreme Court upheld the convictions on the basis that Alabama had a legitimate interest in enforcing preliminary injunctions, so they never addressed the denial of civil rights issues. If the arrest had been for marching or demonstrating without a permit, perhaps the Supreme court would have addressed the issue of denial of civil rights, since they could not get a permit.
Letter From A Birmingham Jail is a open letter penned by Dr. Martin Luther King Jr. during his incarceration at Birmingham city jail.
