Lincoln used his power in the U.S. Constitution and instead issued the Emancipation proclamation. Stating all Southern slaves were free. This did not bother the southern slave holders and they decided that they didn't have to follow the rules of the Union. However slaves in the south tried harder to escape to the north.

It helped to restore Northern morale. It authorised Union troops to rob the enemy of his slaves. And it made it impossible for Britain and France to send military aid to the Confederates without looking pro-slavery.
