when you violate your probation one of 3 things can happen 1. reeive a jail sentence 2 . receive prison sentence equal to your term of probation 3. or revoke your current probation and and start your probation over again. again it depends on what your circum stances are.
It depends on the judge. He could make him serve six years in prison. Or he could sentence him to an additional year (or more) in jail.
They violated probation. They could be sent to jail to serve out the remainder of the sentence, including the two years they were gone.
Yes of course it is.
It all depends on your probation officer you could either be violated and taken in to jail or given a consequence like having to do community service for X amount of hours or a number of things it really all depends on your probation officer if you have a good relationship with your probation officer and have not messed up much then more than likely you will just be told to not do it again I have been on probation for 2 years and this is typically what I've seen
How much remained of their probation sentence when they violated? If they were sentenced to 2 years probation and they VOP'd at 12 months, they could go to jail for the reamining 12 months.
There is no way of determining and/or anwering this question, it is entirely up the the judge who originally sentenced you. Probation is not a free pass, it is a SENTENCE handed down after being found guilty. The judge has the option of doing anything in his discretion, including remanding you to prison to serve the balance of your sentence.
If someone gets a sentence of 7 years plus 5 years supervised probation it usually means that when they get out of prison they will have to also be on probation for 5 years, supervised. This depends on the actual order by the court.
You were found Guilty. You were sentenced to 5 years in prison. HOWEVER - the prison portion of the sentence is suspended and instead, you are ordered to serve 2 years on probation and ordered to pay $500.00 in re-payment to the victim.
You will be charged with the new marijuana PWI offense and face court action for that charge. As far as the probation goes - the sentencing judge who gave you probation in the first place will have the final word on what they will do with you. They may send you inside to serve the entire remainder of your original sentence, or only part of it. It is totally the judge's call.
Whatever your PO told you it would be. It should be on your court papers too under "jail time suspended" Jail time suspended is the amount of time you can receive when you violate.
Did you get it straightened out? You still have to put the felony down on the application in order to have any possibility of being hired and keeping the job.
If you were offered 2 years of probation and did not take it then you will go to trail. This could result in you getting some jail time.
