For most of the war, the South had no overall commander to coordinate the efforts of its various forces. For most of the war, the Confederates had no overall commander. They were effectively commanded by President Jefferson Davis, an ex-West Point officer, who saw himself as a great General. Davis's performance, both as a notional General-in-Chief and as a President, showed that he had moved up out of his league. Much too late, in 1865, he appointed Robert E. Lee to the top job. By then, Lee could do nothing except stay on the defensive until Grant's superior manpower simply wore him down.
The reason in part that he did not sign it was that he had been appointed Commander-in-Chief of the Continental Army more than a year before and was therefore at the time with the army in New York City.
The Confederate Constitution was modeled after the US Constitution with the major exception of legalizing slavery. Also, the term of the Confederate president was limited to a six year term. With that said, the Confederate Constitution mirrored the US's with the president performing the duties of the Commander in Chief. Davis however, saw his role differently. For Davis, he decided to act not only as commander in chief, but also as the general in chief. The Confederate Congress created the position of general in chief, however, Davis never filled it until 1865 when he named Lieutenant Robert E. Lee as general in chief.
