Martial law can only be implemented by an act of congress, and only in a specified area under attack by a foreign invasion. And only for a the period of time as needed to repel the invaders and restore the civil government.

All politicians, law enforcement as well as military have sworn an oath unto the Constitution, to defend it, as well as our Rights, against all enemies, foreign, as well as DOMESTIC. So, if there is no foreign army on your streets, but the president, and/or congress has declared martial law, they are committing treason and are DOMESTIC ENEMIES, and should be dealt with in the same manner as a foreign enemy.

That is why we have a God given, unalienable RIGHT, to defend our lives, which is protected by the Second Amendment. This includes the Right for citizens to form militias that are as well armed as the standing armies. For without that ability, what is to prevent another King George, or Hitler, or Stalin from coming into power, and murdering you and your families?

Any president has the power to do this, since the president is Commander in Chief of the Military. But it would take some very extreme circumstances, which is why it has seldom occurred. The best-known example took place in 1863, during the Civil War, when Abraham Lincoln declared martial law (although the supreme court subsequently reversed his decision).

It should also be noted that politicians will often accuse their opponents of various things, and several of President Obama's opponents have asserted he is ready to declare martial law. This is not true, and there is no evidence to support such a claim.
