When an arrest is unlawful or the amount of force used is excessive. (You better have a judge on scene to make those determinations or you will lose.) Edit by Engl1sh: You especially want to be careful because when it comes right down to it, your word vs. the Police Officer, its more likely in court that a Judge would side with the guy with a badge and legal rights to detain you. You also want to be sure you will not get a 'resisting arrest' charge as well. If you are only defending yourself and the Police Officer is wrongfully detaining you and using force that is excessive, you do have the right to defend yourself. HOWEVER, it is advised that you be completely honest with the Officer, and attempt to explain the situation in a calm and collective manner. Don't get worked up, explain why YOU are the victim, and remember you want to avoid any additional charges if at all possible.
