Its a funny question to answer for a few reasons: 1) You normally need things other than your paycheck, like statements that come or especially Form 1099 (from any accounts or expenses, or even prior years state refund) that come sometime before the end of January. And while a apy stub may be used, the for W-2, sent by your employer is really what you need to use. If your thinking of using a pay stub at a tax service...and getting a "refund anticipation loan" (an RAL, where you get the refund fast almost immeadiate, but really your getting a loan by the Co against the one that will come in a very short while anyway).....DON'T DO IT! These are always shown to be just about the most expensive forms of loans...with the actual amount you pay being several times the maximum legal amount, (but gotten away with by charging aso an over priced tax service, or handling, or something else). YOU LOSE BADLY. 2) This year (2007), because of problems Congress is having a problem deciding on something to do with AMT (which agreeably may not effect you), the 2007 forms haven't even been able to be made by the IRS yet (almost December), and that will take a number of weeks once the law is passed!
As soon as you receive your W2 and the tax forms become available you can file. Some people use their last paycheck stub to file their taxes but this isn't recommended as sometimes the information can be different. You will also need your employer EIN # if filing online and this information isn't on your paycheck stub. A lot of online sites such as Turbo Tax will let you know if you are trying to file your taxes too early as some forms can't be filed online until after certain dates. Alot of tax preparers such as H&R Block will file your taxes using your last paycheck stub also, personally I have never been to a tax preparer as they dont do anything different than I can do on my own. I rather save my money.

You can file a W-5 form with your employer's payroll department, and they're supposed to advance it to you in your paycheck.
You have three years from the filing deadline to file your income tax return to receive your refund. Taxes for 2007 were due on April 15th 2008. You have until April 15th 2011 to file to receive a refund. Never if you have a tax liability.
If you have a job you are legally required to file taxes. Your employer's responsibility is to take the taxes out of your paycheck and "pay the man," as it were. If your W-2s reflect taxes paid to the Gov't, you are in the clear - if you file.

It is NOT legal to do this.
Get your 2008 taxes filed on time (or at least file an extension) even if you are not done with your 2007 taxes. You have already reached the maximum failure to file penalty for 2007. If you don't get your 2008 taxes filed on time, you will get a whole new set of penalties for 2008.
If your baby is not born on or before Dec. 31, 2007 then you cannot file your child on your 2007 taxes. If your baby is born on Jan. 1, 2008 then you can claim your child on your 2008 taxes that you file in April 2009

For tips for Ohio Taxpayers, see the link I have provided below. In general, if you have any taxes withheld from your paycheck, you have to file a return to get your refund back, no matter what the amount of your wages was. You can probably go online and find a free service that will help you file your taxes, for low income people.
