The Afghani War was a war about the US, UK, and Afghanistan VS. the terrorist groups in Afghanistan. The Senate always declares war, it is part of the constitution, and since we have been in the Afghani War for 10 years now, yes the Senate approved.

If the War in Afghanistan were (legally speaking) a war, which it is not, then no, the War in Afghanistan would not be constitutionally legal as the President never declared war. However, the Constitution only recognizes wars against sovereign entities and as the War in Afghanistan is (and the War in Iraq was) a conflict to suppress non-state actors and therefore there is no breach in the Constitution.
