I have received a demand from the Council for repayment of £500 because they made an error in assessing Housing Benefit over a year ago. The Housing Benefit a[plication form was correctly filled out. Is this a valid demand. Thanks. C. Jones

Can a collection agency sue for a 'charged off' debt?

Yes, the term "charge off" does not render the debt invalid or uncollectible.

Are you still liable for a debt after a credit card company charges off your account?

Yes, a charge off does not mean a debt is invalid nor uncollectible. The term is used by creditors to indicate a debt that they believe is not collectible under normal procedures and they are clearing the debt from their books for taxation and operational purposes. The OC will then refer (or sell) the debt to a collection agency or collection attorney for further action.

Should you pay a debt that is charged off?

The term 'charge off' does not define the debt as invalid and uncollectible. The term is something that creditors use to signify a debt is in collection status which relates (in a roundabout way) to taxation purposes. One should always honor their debts when it is at all possible. Not paying a 'charged off' debt can subject the debtor to collection action from third parties and/or a civil suit.

Can a Collection Agency re age an old debt?

A creditor or collector cannot arbitrarily change the date of the DLA in order to negate an SOL or enter on the debtor's credit report or other similar actions. However, if the debtor made an attempt to repay, negotiate a repayment or other such contact with the collector the original DLA becomes moot until the debt is considered defaulted again. If the question refers to the continued collection of a debt after the SOL has expired that is allowable. Debts only become invalid when the creditor or collector who buys the debt "forgives" the money owed. The debtor will then receive a 1099C form which designates the forgive debt as income and it must be reported to the IRS as such.

Why can't you get a detail Billing statement from a collection agency?

You can, but not directly from them. The debt collector is the agent of the original creditor and does not likely have all records of the debt or contract. The collector, as the agent of the creditor can go back to the creditor and request a reconciliation of payments and history, and will in fact be required to so that it van be verified if you notify the collector in writing that the debt is invalid due to payment or some other reason.

Yes, a collection agency can attempt to collect a debt that was settled by another agency if they believe the debt is valid. However, if the previous agency settled it as 'not valid,' you may dispute the debt with the new agency and provide them with documentation supporting the previous resolution.
