The crime of inciting to riot can be ruled by some judges and jurisdictions to be carried out by an ABUSE of the freedom of speech- Someone shouting out Racial epithets at, say a ball game or boxing bout with the idea of Triggering a race riot- could be charged with inciting to riot- this is not the same as say, assault and battery or vandalizing autos, stadium property, etc. Fans shouting (hit the Trigger, Kill the N-R at a Boxing bout did happen and might have been prosecutable if a Riot started. This happened at the Johannson (white) versus Paterson ( Black) boxing bout.
