You can get Kyogre in HeartGold. You can get Groudon in SoulSilver. You need to get the Blue/Red Orb from Mr. Pokemon after you received the National Dex and the Kanto Starter Pokemon from Professor Oak. After acquiring either the Blue/Red Orb go to the cave on Route 47, The Embedded Tower, Search the Cave and you will find Groudon or Kyogre.
Note: Kyogre and Groudon are Level. 50.
