It is illegal in the US unless there is no other way to get the fetus out. It's big that late. That also applies in states who have banned it since you wont ban a procedure and have her killed. She can be too weak or sick to go through premature labor with a dead or non viable fetus. Some have banned it completely and others just after 24th week. Before 24th week they are not considered viable and can not feel pain or is aware. No other country really uses this procedure.
