Civil damages give a monetary award or judgement. Civil Courts cannot send a person to jail. However, if testimony reveals that a person or persons in a Civil Court has committed a crime, that information is typically sent to the Prosecutor who can bring charges that may lead to a jail sentence.
It can be both, criminal charges can apply under the FCC regulations and any state statutes and the "hacker" can also be sued for damages in civil court.
