Tenure of Office Act of 1867
The 20th Amendment to the United States Constitution violated the tradition that presidents controlled their cabinets by establishing fixed terms for the president and vice president. This amendment stated that the terms of the president and vice president both end at noon on January 20th, four years after the previous inauguration. This limited the president's control over their cabinet as their terms would no longer align, potentially leading to a president serving with a cabinet appointed by a prior administration.
Tenure of Office Act of 1867 made it illegal for the President to fire a cabinet member without the approval of Congress. It was used as grounds for impeaching President Andrew Johnson. It was later declared to be unconstitutional.
