No individual can "press charge" - they can only swear out a complaint in court, or they can report the battery to law enforcement. It is the victim of the violence who must swear out the complaint or, in the case of a juvenile, the parent or guardian of the juvenile.
yes you can
The police or the victim are the only people who can press charges in an assault case.
You can be arrested, but it would be a difficult case to prosecute if the vicitim does not want to press charges.
Citizens cannot "press' or "drop" charges. That function can only be done by law enforrcement or prosecutors. Citizens CAN refuse to either complain or testify in their case. Once they have refused to complain, or refused to testify, it is unlikely that they would be able to re-institute the complaint once they had dropped it.
In many cases you can choose to file charges at a later date, assuming a report was in fact filed and the case hasn't been closed.
You will get off with a misdemeanor penalty if you have money, no prior convictions and don't have lots of other pending charges. The victim has not say in the case and usually ends up broke on state aid and a victim again. If you are a criminal you have rights if your a victim you just have injury. Sorry victims.
Not necessarily. It can depend on the type of case. If a murderer's victim dies, they don't drop the charges against the person that murdered them, do they?
As long as you were authorized to write checks, no, the other person has no case to press charges against you.
In most states yes. But not in all states.
Nobody can press charges against you except the prosecutor, if they decide to pursue the case a warrant will be issued for your arrest.
