In a nutshell:Henry declared himself head of the Church in England and granted himself a divorce from Catherine of Aragon. The pope then excommunicated him.
If Wife refuses divorce on ten month marriage with no children or assets, can a divorce nd granted
You have misunderstood. It is "no fault DIVORCE"! That means that you are not required to have a compelling reason to end the marriage if you are to be granted a divorce. You don't have to have a reason, other than you want to. There is no fault assigned to one or both partners.
You need to check your specific state's laws, but I know in some states if the divorce was granted on the grounds of adultery, and the 'other woman' is named in the divorce papers, then the husband cannot marry the other woman for at least 30 days after the divorce. If he does, then that marriage is not legal. The same applies if the husband files for divorce on the gounds of adultery, as well. But if the divorce was filed and granted on other grounds, then you are free to remarry as soon as you obtain your new marriage license.
If there was not a legal dissolution of marriage petition filed and a final divorce decree granted, the first marriage would still be valid and the second marriage would be inconsequential in the legal sense, meaning, divorce proceedings would not be required for the second marriage.
Yes. Marriage is a legal status. You are married until you are granted a divorce by a court of law.
no, there is no such thing as a legal separation for divorce in FL. divorce must be granted by the courts.
Grants of divorce or marriage are recognized by the Full Faith and Credit clause. It appears in Article IV of the U.S. Constitution.
I assume you are saying that one wife filed for divorce and you have married someone else? If the divorce from the first wife has not been finalized and granted by the courts, you are still legally married to the first one and YOU are the bigamist.
If the marriage does not work you may want to remarry one day so yes. Most people are Catholics there though so you might not be granted divorce from the church.
No. unless you have official divorce. i suppose after filing divorce you have to stay away for 1 year before divorce is granted.
Unfortunately, no. If one party to a marriage wants to get a divorce, then it will be granted with or without the consent of the other party. Courts simply will not enforce a situation where it is no longer working for some. You have the right to contest the divorce but declining the divorce will not stop the procedure from happening.
