It depends. If the landlord is a single person, you would probably pay to the estate or to a spouse. If the landlord is an employee for a corporation, you would probably pay to the corporation.

BUT, it just depends. Without know the exact details, it's difficult to give you a good answer.

Can a landlord file a claim if the tenant dies owing rent?

I'm no lawyer but... The estate of the deceased tenant should pay any debts before disbursing the money to beneficiaries. The landlord should file a claim against the estate.

Can a landlord charge you rent at the same time he charges another tenant for the same dwelling?

Yes: as long a you are a tenant in a dwelling at the hands of a landlord, you are renting from him and must pay rent.

Is it illegal to have your tenants pay rent to another individuals bank account while you are going through foreclosure and not making mortagage payments?

Until the foreclosure sale happens, the tenant owes the rent to the landlord. What is happening between the landlord and tenant is really none of the tenant's business. And, yes, a landlord can certainly ask the tenant to pay the rent to someone else, acting as an agent. However, the tenant would be within his rights to say, "No, I'll only pay to the landlord."

Does a cosigner have to pay the rent when tenant dies suddendly?

I'm pretty sure the cosigner doesn't have to pay it. If the tenant dies suddenly, I wouldn't think his/her family would be obligated to pay the rent, because I'm sure they would move everything out when the tenant dies.

What are tenants options when landlord foreclose?

For the purposes of answering this question, I presume that the tenant is a rental tenant and that the Landlord is under foreclosure. Tenant must continue to pay the rent to the landlord as long as they have control over the property. The Foreclosing company, once it takes over, must give the tenant specific instructions on to whom and where to pay their rent.

Should a tenant pay rent to a landlord who has lost his renters privilege?

Yes. The relationship between the landlord and bank has nothing to do with the tenant.

Can a landlord in South Carolina evict a tenant if she has not gotten any money from a real estate agent in more than 3 years?

If the tenant is following the instructions given on a lease, or is following any written instructions on how, where, and when to pay the rent, and is doing so on a timely basis, then there is no reason the landlord can evict them. If the landlord has contracted a real estate agent to collect the rent on their behalf, and the tenant is paying the real estate agent in accordance to the instructions on the lease, then the tenant is not responsible for any rent the real estate agent has not paid the landlord. Otherwise, the basic rule is that the tenant must pay the landlord the rent every month, and is responsible to see that the landlord is paid in accordance to the terms on the lease.

What can can be done if a tenant doesn't pay his rent and it turns out that the tenant is an illegal alien?

The landlord should serve a notice to quit for non-payment of rent. The fact that the tenant is an alien has nothing to do with the landlord. The landlord who brings it up in court is a fool - the obvious question is, why did the landlord not act on that information before? Waiting to use that information in court is completely disingenous.

How long by law does a landlord after 15 days late on rent does a landlord have to give you to get rent paid before the can ask you to move?

A landlord can, at any time, initiate eviction proceedings against the tenant if he fails to pay his rent on time. Normally the landlord does this after the fifth day of default.

Do you have to pay rent to a landlord who's property is in default?

Yes, you have to pay rent to a landlord whose property is in default. As long as the landlord still has control over the property he can still collect rent from you and evict you if it's not paid. A foreclosure of a home is a matter between the owner of the home and his lender, not the tenant.
