The courts can do this, as well as the State child support agency.

Each StATE HAS A CHILD SUPPORT AGENCY. THE STATE'S ATTORNEY/DISTRICT ATTORNEY ALSO HAS CHILD SUPPORT ENFORCEMENT RESPONSIBILITIES.
The State's Attorney/District Attorney or your State's child support agency can do this.
It's hard to say without knowing the exact terminology the caller used. A DC can refer the account to a collections attorney who then contacts the debtor. Once the account has been referred to the attorney the DC can contact the debtor once to inform the person that the account has been referred to an attorney for legal action. A DC cannot state that the collection agency are filing or have filed a lawsuit.
A collection agency in any state would need to notify you first.

Whenever I am helping a client with a collection agency, the first thing I do is try to contact the state agency that licenses collection agencies. I also try searching on Google and that usually works.
The US Federal Trade Commission has a good web site with information on making complaints.Check with your State's Attorney General or Department of Licensing. Many states have their own rules on collection agencies, frequently including a requirement that the agency register with the state or face fines. For example, Washington has a web site that is available for public searches to find all legitimate (at least registered) collectors.If the agency contacting you is from out of state, they still may need to register and pay license fees in your state.
