If all the cars are going in the same direction, then car 3 is At Fault for either following too closely or negiligent operation. As long as the cause of car 2 hitting car 1 was ONLY the imact of car 3, that is, if he wasn't following too closely too, car 2 has no fault and no liability.

Who is at fault when there is a 3-car collision and Car 2 hits the Car 1 without applying the brakes and Car 3 rear-ends Car 2?

Sorry to inform you as you were probably in car 2 or car 3. Whenever a car is rear ended the car doing the hitting is usually at fault as it is considered that they were tail-gating and thus did not have enough time to stop. I know you didn't want to hear this. Good luck.

Fault is determined by who committed a driving infraction, not who has insurance. If you have no collision insurance, you are responsible for the damages to your own vehicle unless another driver is determined to be at fault.

What does no fault pay and what does your insurance pay?

No fault coverage is a type of auto coverage that most states require a registered owner of a car to maintain. It pays a percentage of the medical expenses and lost wages of that person or members of his/her household who may be injured as a result of a collision. It pays the covered person without regard to fault for the collision. It pays nothing to the driver or owner of the other vehicle or property involved in the collision.

There is not deductible with liability insurance coverage. Liability pays the party who is not fault for their damages without a deductible. If you were at fault collision would pay for damages to your vehicle but you will have a deductible of whatever you selected when you purchased the insurance policy.

What if you were in a car accident and it was not your fault but you had no collision?

If the police report says the other driver was at fault, try to recover from his or her insurance company. If you don't have collision coverage, you can't collect from your insurance company.
