Speaking from experience if a person opens their care door into a lane of traffic, they are responsible if it gets hit. If you legally go around a car that is double parked and the occupant opens their door and you hit it, they are responsible. Don't move. Call the police.
Well if you were backing in and hit someone then it is your fault. But if they hit you, then it is their fault.
Rule of thumb: if two cars are in an accident and only one of them is moving, it's the fault of the car that was moving.
The one backing out, because you should realize someone is opening a door.
It is their word against yours unless they have some proof it was you.
I beleive, whoever's car is moving (wheel-wise), is at fault.
