The name cannot be protected by copyright (and is not registered as a trademark), and both the name and the general look of the character predate his association with Mad Magazine. In fact, Mad has been accused of copyright infringement twice (on a 1914 image and a 1936 image), but successfully showed that the plaintiffs had taken it from even earlier sources.
