You will have to communicate well with the neighbor because removing the root will affect his tree. Hopefully, the neighbor will pitch in some money as well, but it is not something you should expect.
No the roots cannot be trimmed without damaging the tree.
If the tree belongs to your neighbor, it is their responsibility to maintain it. Try talking to your neighbor about the situation and see if you can resolve it together.
Unless you can prove that the neighbor was negligent by not removing the tree then your insurance pays for your damage. For negligence to occur the neighbor would have to know that the tree was dead and about to fall on your property. Usually you would have had to notify your neighbor in writing of the tree's impending falling for them to be liable.
You might want to check your local ordinances (laws). I am pretty sure that a tree that is planted in your neighbor's yard and overhangs into your yard can be trimmed back to the property line. It probably won't make your neighbor happy if it kills the tree though. Just be sure to check the local laws in regard to this beforehand.

The neighbor is responsible for his own property. If your tree fell on his house, he is responsible for the damage. That is how homeowners insurance works. * No one is "legally" responsible if it was a result of a natural occurrance. The neighbor whose tree fell and damaged the other person's property cannot be held accountable for a situation that was not in his or her control. If the tree fell as a result of a storm, the person whose property was damaged should claim it on their homeowner's insurance is possible. If it fell and damaged property due to it being trimmed or removed, the liability lies with the person who was taking the action. It would be a nice gesture if the neighbor who owned the tree agreed to share the damage cost, but in the majority of cases he or she cannot be held legally liable.

No matter what you say or your neighbor answers, you now have 2 alternatives - limb(trim) the tree 5 ft from the ground on your side of the property to match her side, or cut it down. Pines do not have latent buds, so your tree will never "fill in" below what your neighbor cut. Pines should be "limbed up" because the lower limbs will die back eventually on their own due to lack of light. Only you can decide which looks better - a limbed up tree or no tree. Getting angry will not restore the tree.

The NYC Christmas tree is put up in Rockefeller Center each year. The tree is brought in from nearby states. The tree is cut down and tied onto a large truck for transport with the branches tied down. The branches are not trimmed off.
