actually just found out in the state of Virginia--where we live--it is the responsibilty of the finance company to repair, fix etc..., but after speaking with a lawyer and showing him the documentation from the mechanic where the car was picked up(as it just had a gas problem fixed and nothing else was wrong with it) and the documented phones calls to our fiance company and the towing company...we were advised to send a letter with the Virginia code stating that it is their responsibilty and the other documentation from the mechanic, storage guy and so forth. Anyway will see where this gets us and will update what happens. Also for all of you all out there the code of Virginia can be searched at http://leg1.state.va.us/000/src.htm.

If the owner of the truck allowed an unlicensed driver to take the truck, then the owner is responsible - even if the driver lied about where he was going. If the unlicensed driver just took the truck, then a police report would need to be filed and charges pressed against that person - he can be sued for damages.

Depends on why it was towed. If it was being repossessed, you're not going to recover anything.
