The extent to which human rights are recognized and protected in the People's Republic of China is a matter currently in dispute between the government and the human rights bodies. China is one of the countries which is alleged to be in gross violation of the human rights.
The protection of one's fundamental human rights cannot be protected by his/her self but for the government.
protected them because they had the right as well as any other human did

All rights protected in the constitution are basically the human rights. But nowadays the definition of human rights is basic fairness. For example, we can't make someone our slave just because they're black. Or we can't sell someone just because they're a woman. We can't fire someone because they have brown hair. And we can't do those things because it's discrimination, and discrimination is unconstitutional. It's basically a circle.
Civil rights are protected by the Constitution (and the enforcement thereof).
