After the surrender, they found it easy to make him a scapegoat, as he had been born in Philadelphia, and could be painted as not a true Confederate.
Because of this, he felt it was his duty to resign his commission, and he re-enlisted as a private. Soon he was promoted Colonel, but was not sent out on operations again.
