In America capital punishment is usually reserved for murderers. In that case the victim would be dead and therefore would not be able to decide the capital punishment for the offenders. If you include the families of murdered people as victims you wouldn't want them to decide the fate of a person's life. A person should get the death penalty based on aggravating and mitigating factors and not in whether the victim want's them to be put to death. This puts more emphasis on revenge, which is personal, and less emphasis on retribution, which is more just.
Once a case of serious murder is done the jury decide on the verdict and the judge passes the capital punishment.

In most states that currently have the death penalty the most common crime committed that warrants death is 1st Degree Murder, or multiple counts of 1st-3rd degree murder. However, as with any judicial system it is entirely up to the court to decide based on the circumstances. Some states have even warranted capital punishment in crimes involving sexual abuse of a minor.
For some people, it's not. For others it is not enough punishment for the bringing about the death of a loved one. A good man can kill in self defence, if no other option is available. A good man can kill as part of his duty in a just war.
