Because soap and water are NOT oil based. Oil based means you need to use an oil-based thinner to clean brushes and spills.
The materials used in oil-based paints are not soluble in water, even with the added surfactant effect of soaps. (Some paint may come off hands as the soap loosens the dead outer layer of the skin.)
Because it stains the brush and won't be able to come off, my advice to it, is, that don't use oil based paint anyway it is bad for the environment.

You can clean it in hot water with a lot of soap. I do that anyway, after using thinner and it leaves my brushes soft and smooth.
That depends on how good a job you want to do. Though they cost more, and they are a pain to clean with an oil based paint like Rust-Oleum, quality brushes (top of the line synthetics) give you the very best job, no matter what your skill level as a painter. Two excellent brushes I can recommend are Wooster Pro Classic and Purdy.
Early on, straight water was used. Later, turpentine and specialty brush cleaners were developed.
